This Site is operated by GDS Infrastructure and its related entities and affiliates (collectively "GDSI").  By using GDSI's Site you (meaning any user of this Site) are deemed to expressly accept and be legally bound by the following terms and conditions.  Please read the terms and conditions carefully.  If you do not wish to be bound by the following terms and conditions, please immediately cease using our Site and downloading any further content from it.

  1. "The Site" means the whole or any part of the webpages, including individual elements of design, code elements, all written content, text, sounds, graphics, photographs, logos and other content.

The Site is provided for general guidance and information purposes only.  The information provided on this Site is not intended to be construed as, or substitute for, the provision of professional advice.  We expressly do not purport to give professional advice over our Site.  You should consult with a GDSI professional advisor in your region in relation to any information on the Site before seeking to rely on it.

Certain links on this Site may lead to third party servers, operators or websites over which GDSI has no control.  GDSI disclaims any liability in relation to any links to other servers, operators or websites. It is recommended that you review the relevant website's terms and conditions of use before proceeding.

Content on our Site - including any concepts, ideas, methods, procedures, processes, know-how, publications, models, products, programs, software, technology, techniques, templates, designs, photographs, art work, graphics, logos and information on or described on the Site - may be copyrighted, proprietary or subject to intellectual property or other rights.  Any unauthorised use of any materials, content or information on our Site may violate copyright, trademark and other laws or applicable intellectual property or licensing rights.  No materials, content or information on our Site may be used, reproduced, transmitted or exploited in any form or by any means without the express written permission of your regional GDSI office.

Access to some areas on our Site are deliberately restricted by the use of security measures ("Secure Sites") to certain authorised user(s), GDSI  client's or employees of GDSI who have been granted unique credentials or usernames and passwords ("Authorised Users").  No persons other than Authorised Users are permitted to access Secure Sites.  Authorised Users are not permitted to share or transfer their credentials to enable others to access Secure Sites.  Authorised Users are responsible for maintaining the security and confidentiality of their password, username and other credentials. Any attempts by unauthorised persons to gain access to Secure Sites or the fraudulent use or misuse of an Authorised User(s) credentials will be actioned appropriately by GDSI. 

  11. In circumstances, where you provide us with any personal information, personal data or personally identifiable information on our Site, we collect, use, secure and store that information in accordance with our Privacy Policy.  A copy of our Privacy Policy is available here.

  12. These Terms of Use are effective as of 01 February 2023.  We may make changes to our Site or our Terms of Use from time to time by posting a copy of the updated Terms of Use to our Site.

  13. You agree to defend, indemnify and hold GDSI and its related entities harmless from any and all liabilities, costs, expenses (including legal costs on a full indemnity basis) in relation to the violation of these Terms of Use by you or in connection with any misuse, misappropriation or unauthorised reproduction or use of any information, content or materials on our Site by you.

  14. By accessing the GDSI website, you allow GDSI to collect your geographic location provided by your IP address and use it to provide county- and region-specific information.

Privacy Policy

This privacy policy (the "Policy") sets out in accordance with the Privacy Act 1988 (Cth) the way in which GDS Infrastructure ("GDSI") (ABN 62 784 457 823) and its associated entities (together GDSI, we, us or our) may collect, store, use, manage and protect your personal information. By:

  • accessing, requesting information on, enquiring about, or providing feedback in relation to, GDSI's operations, services or projects (online, in writing, by telephone or in-person); or

  • otherwise providing personal information to GDSI, its officers, agents or employees
     

after this Policy has been brought to your attention, you acknowledge and consent to the use, collection, storage or disclosure of your personal information by us in accordance with this Policy and the Privacy Act.

If you do not agree to us handling your personal information in the manner set out in this Policy you must immediately cease to access this website, our operations, services and projects and you should not provide us with any of your personal information.
 

However, if you choose not to provide your personal information to us, we may not be able to answer your query, provide any information or otherwise effectively address any matter you raise with us.

If you are a contractor, we may collect personal information about your working history with us.

We store your personal information in hard copy format and digitally, on-site or with a third party storage provider.
 

GDSI uses commercially reasonable safeguards to store and protect any information transmitted through its websites.
